The Power of the Grand Jury: De Jure vs. De Facto
According to Corpus Juris Secundum, a foundational legal encyclopedia:
“There cannot be a grand jury de facto when there is a grand jury de jure.”
• De jure means “lawful” and constitutionally established.
• De facto means “in practice,” often without true legal standing.
So, when the people lawfully assemble under common law and reestablish a de jure grand jury, any existing government-imposed grand jury becomes illegitimate—void of lawful authority.
This is not rebellion. This is restoration.
Purpose of a Grand Jury Was Always the People
Our Founders gave us this power:
• To investigate government corruption
• To hold public officials accountable
• To protect liberty and truth at the local level
But over time, this power was stripped away, hidden behind legal walls, and replaced with closed-door systems run by the very people they were supposed to hold accountable.
The Firepower of Jury Nullification
Few know this, but jury nullification is one of the most potent tools for liberty we’ve ever had. It means: A jury can refuse to convict—even if the defendant broke the law—if that law is unjust, immoral, or misapplied.
John Jay, the first Chief Justice of the United States, told jurors in 1794:
“The jury has a right to judge both the law as well as the fact in controversy.”
Today, judges often deny this power or lie about it in courtrooms. Why? Because informed, courageous jurors are a threat to tyranny.
